Terms of Service

By accessing or using the Mayday L. Translation services (the “Service”), operated by JMK Law P.C. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and JMK Law P.C. regarding your use of the Service. Your use of the Service in any manner constitutes your acceptance of these Terms. We reserve the right to update or modify these Terms at any time, and your continued use of the Service after such changes constitutes acceptance of the revised Terms.

Mayday L. Translation provides professional AI-powered translation services utilizing advanced artificial intelligence engines, including but not limited to Claude (Anthropic), GPT (OpenAI), Gemini (Google), and DeepL, combined with rigorous human expert review.

Our proprietary 15-step translation workflow uses AI engines as tools to assist in the translation process. All translations undergo comprehensive human review by:

• Legal documents: Licensed U.S. attorneys with subject-matter expertise
• Medical documents: Medical professionals and certified medical translators
• Technical documents: Domain-specific experts with relevant industry experience
• Other fields: Qualified subject-matter experts appropriate to the document type

The Service includes document translation, certified translation, back-translation verification, terminology management, and related professional language services.

To access certain features of the Service, you may be required to create an account. When registering, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Maintain the security and confidentiality of your login credentials, including your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account or any other breach of security

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete, or if we reasonably suspect unauthorized or fraudulent activity.

The Service offers multiple membership tiers, each with distinct pricing, benefits, and payment terms:

All prices are quoted in U.S. dollars (USD) and are subject to change with reasonable advance notice. Tier upgrades occur automatically based on cumulative usage. We commit to pricing transparency; any applicable fees, surcharges, or additional costs will be clearly communicated before you confirm an order.

All payments are processed securely through Square, Inc. By submitting payment through the Service, you agree to Square’s terms of service and privacy policy in addition to these Terms.

Payment terms vary by membership tier:

• Guest: 100% payment upfront at the time of order submission
• Standard: 50% deposit upon order placement; remaining balance due upon delivery
• Business: Net 15 — full payment due within 15 days of invoice date
• Prestige: Net 30 — full payment due within 30 days of invoice date

Late payments may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend services for accounts with overdue payments. All fees paid are non-refundable except as expressly set forth in Section 9 (Cancellations & Refunds).

We employ AI-assisted translation as a tool within our professional workflow, enhanced by thorough human expert review. While we strive for the highest levels of accuracy and quality in every translation, we cannot guarantee 100% accuracy in all cases due to the inherent complexities of language and translation.

Certified translations delivered through the Service include a Certificate of Accuracy, attesting that the translation is a true and faithful rendering of the source document to the best of the translator’s knowledge and ability. Certified translations are accepted by USCIS, U.S. courts, and government agencies.

If you identify any errors or inaccuracies in a completed translation, you may submit a revision request within 30 days of delivery. We will review and address legitimate concerns at no additional cost.

Client-owned content: You retain all intellectual property rights in your source documents. Uploading or submitting documents to the Service does not transfer ownership of those documents to us.

Translated documents: Upon full payment for the translation service, ownership of the translated documents transfers to you, the client. You may use, distribute, and reproduce the translated documents without restriction.

Our intellectual property: JMK Law P.C. retains all intellectual property rights in the Service itself, including but not limited to our proprietary translation workflow, technology, software, algorithms, user interface, branding, trademarks, and trade secrets. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

We treat all documents submitted through the Service as strictly confidential. We implement industry-standard security measures to protect your documents throughout the translation process.

In the course of providing the Service, your documents may be processed through third-party AI engines (Claude, GPT, Gemini, DeepL) as part of our translation workflow. Document handling through these AI services is governed by our Privacy Policy and the respective privacy policies of those AI providers.

We will not share, sell, or disclose your documents or personal information to third parties except as:

• Necessary for the delivery of the Service (e.g., sharing with assigned translators and reviewers)
• Required by applicable law, regulation, or court order
• Authorized by you in writing

All translators, reviewers, and staff involved in the translation process are bound by confidentiality obligations.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JMK LAW P.C., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO JMK LAW P.C. FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE DATE THE CLAIM AROSE.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You agree to indemnify, defend, and hold harmless JMK Law P.C., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney’s fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content or documents you submit through the Service
• Any claim by a third party related to or arising from your use of the translated documents

This indemnification obligation shall survive the termination of these Terms and your use of the Service.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you specific rights regarding your personal information. Under the CCPA, you have the right to:

• Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you
• Right to Delete: Request deletion of personal information we have collected from you, subject to certain exceptions
• Right to Opt-Out: Opt out of the sale of personal information. We do not sell your personal information to third parties
• Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights

The Service is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. In compliance with the Children’s Online Privacy Protection Act (COPPA), if we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information as soon as possible.

If you believe that a child under 13 has provided us with personal information, please contact us immediately at support@maydaylegal.com.

Our email communications comply with the CAN-SPAM Act. We commit to the following:

• We will not use false or misleading subject lines or header information
• We will clearly identify promotional messages as advertisements where applicable
• We will include our physical mailing address in all commercial emails
• We will honor opt-out and unsubscribe requests promptly, within 10 business days
• We will not use purchased email lists or send unsolicited commercial emails

You may opt out of non-transactional emails at any time by using the unsubscribe link included in our emails or by contacting us directly. Please note that transactional emails related to your account activity and order status are not subject to opt-out.

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes, we will notify you by:

• Posting the updated Terms on this page with a new “Last Updated” date
• Sending an email notification to registered users
• Displaying a prominent notice within the Service for a reasonable period

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must discontinue use of the Service.
